Terms and Conditions
Please read the following Terms and Conditions carefully before using the Flotal platform or acquiring any of the products and services offered by Centro Camionero Montajes de Chiapas S.A. de C.V. Use of our platform implies full and unconditional acceptance of these terms.
I. Introduction
These Terms and Conditions govern the use of the Flotal digital platform, its associated services and the acquisition of products marketed by Centro Camionero Montajes de Chiapas S.A. de C.V. (hereinafter CCM), a company incorporated under the laws of the United Mexican States.
By accessing, registering or using the Flotal platform, the User unreservedly accepts these Terms and Conditions in their entirety. If you do not agree with any of the terms set forth herein, you must refrain from using the platform and CCM services.
CCM reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication on the platform. It is the User's responsibility to periodically review these terms.

II. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meaning indicated below:
CCM / Centro Camionero Montajes: Centro Camionero Montajes de Chiapas S.A. de C.V., the company responsible for the Flotal platform and the provision of the services described in these terms.
Flotal / Platform: Digital fleet management system that includes the website, mobile application and all associated digital services.
Client: Natural or legal person that enters into a service contract with CCM for the administration, monitoring or optimization of their vehicle fleet.
Quote: Formal document issued by CCM describing the services or products offered, their technical specifications and the corresponding price, with a specified validity period.
User: Natural person authorized by the Client to access and use the Flotal platform through access credentials.
Service Contract: Formal agreement between CCM and the Client establishing the specific terms for the provision of fleet management services.
License Agreement: Agreement granting the Client the right to use the Flotal platform under the conditions established in these terms.
Pressure Sensors / TPMS: Physical tire pressure and temperature monitoring devices marketed by CCM under the HawksHead brand.
Privacy Notice: Document describing the processing of personal data collected by CCM, available at flotal.com.mx/aviso-de-privacidad.
III. User Registration
To access the features of the Flotal platform, it is necessary to create a user account by providing truthful, complete and up-to-date information. Each user is responsible for maintaining the confidentiality of their access credentials and all activities carried out with their account.
If you detect unauthorized use of your account, you must immediately notify CCM at soporte@flotal.com.mx. CCM shall not be liable for damages or losses arising from failure to comply with this obligation.
IV. Legal Capacity
To contract CCM services and use the Flotal platform, the User and/or Client must meet the following requirements:
Requirements to enter into contracts with CCM
- Be 18 years of age or older or be legally emancipated.
- Have legal capacity to enter into contracts under applicable Mexican law.
- When representing a legal entity, have sufficient authority to bind said company.
- Provide truthful, complete and up-to-date information during the registration and contracting process.
V. Collection and Use of Fleet Data
The Flotal platform collects operational data from registered vehicles (GPS location, tire pressure and temperature, maintenance history, among others) for the exclusive purpose of providing the contracted services and generating reports and indicators for fleet optimization.
Fleet data is the property of the Client. CCM will use such data solely for the provision of contracted services and will not share it with third parties without the Client's express authorization, except in cases provided for in the Privacy Notice or by legal requirement.
VI. Client Obligations
- Provide truthful information and valid documentation during the contracting process and throughout the term of the contract.
- Make timely payment for contracted services in accordance with the agreed deadlines and conditions.
- Use the Flotal platform only for the legal purposes established in the service contract.
- Promptly notify CCM of any changes in company data or fleet characteristics that may affect the provision of services.
VII. User Obligations
- Maintain the confidentiality of access credentials and not share them with unauthorized third parties.
- Use the Flotal platform in accordance with these Terms and Conditions and the usage instructions provided by CCM.
- Immediately report any failure, error or misuse of the platform through CCM support channels.
VIII. Services and Products
CCM offers vehicle fleet management services, including: real-time monitoring, performance reports, cost optimization consulting, TPMS sensor installation and configuration, training and technical support.
Physical products marketed by CCM (HawksHead TPMS sensors and accessories) are subject to inventory availability. Technical specifications are available in the corresponding product sheets.
CCM reserves the right to modify, update or discontinue services and products with prior notice to the Client. In the event of discontinuation of essential contracted services, CCM will offer alternatives or proceed with a proportional refund of the amount paid.
IX. Payment for Services and Products
Prices for CCM services and products are expressed in Mexican pesos (MXN) and include Value Added Tax (VAT) unless otherwise indicated. Prices are subject to change without prior notice until the formal quote is issued.
Payment for monthly subscription services must be made within the first 5 business days of each month. Late payment may result in temporary suspension of service without liability for CCM.
Accepted payment methods include bank transfer, bank deposit and credit/debit card through authorized channels. Cash payment is not accepted for subscription services.
CCM will issue the corresponding digital tax receipt (CFDI) within 3 business days following receipt of payment, in accordance with the tax information provided by the Client.
X. Product Delivery
Physical products purchased from CCM will be shipped to the address indicated by the Client via courier services. Shipping costs will be indicated in the quote and may vary depending on the destination and weight of the order.
CCM will not be responsible for delivery delays caused by external factors such as strikes, natural phenomena, customs issues or force majeure. The Client will be notified of any foreseeable delay.
XI. Delivery Times
Delivery times are estimated and may vary depending on inventory availability and destination location. CCM will make its best effort to meet the indicated deadlines.
Estimated delivery times are:
A) Shipments within Chiapas
Orders with immediate availability: 2 to 5 business days.
Orders under special order or import: 15 to 30 business days depending on supplier availability.
B) Shipments to the rest of Mexico
Orders with immediate availability: 5 to 10 business days.
Orders under special order or import: 20 to 45 business days depending on supplier availability.
XII. Order Changes
Changes to a confirmed order must be requested within 24 hours of confirmation by emailing contacto@flotal.com.mx. CCM will evaluate the feasibility of the change based on the order status.
Once the order has been processed or shipped, no changes will be accepted. Approved changes may result in a price adjustment, which will be communicated to the Client before proceeding.
XIII. Returns
CCM accepts returns of physical products within 30 calendar days of receipt, provided the product is in its original packaging, unused and undamaged. The Client must cover return shipping costs.
Returns are not accepted for products showing evident wear, installed products or products with broken warranty seals. To initiate the return process, contact contacto@flotal.com.mx with your order number and description of the reason.
XIV. Product Warranty
HawksHead TPMS sensors marketed by CCM come with a 12-month manufacturer's warranty from the date of purchase, against manufacturing defects.
The warranty covers:
To make the warranty valid, proof of purchase must be provided and the product must be sent to CCM facilities or to an authorized service center. Shipping costs are borne by the Client.
CCM will determine whether the defect is covered by the warranty and, if so, will proceed with repair or replacement of the product at no additional cost to the Client.
- Manufacturing defects in materials and electronic components.
- Data transmission failures under normal use conditions.
- Factory calibration problems not caused by the user.
- Screen or monitor defects that are part of the TPMS system.
The warranty does not apply in the following cases:
- Damage caused by improper use, negligence or accident.
- Modifications or repairs made by unauthorized personnel.
- Damage caused by extreme environmental conditions or exposure to corrosive substances.
- Visible physical damage such as bumps, falls or liquid immersion.
XV. Refund Policy
Refunds for products returned in accordance with the returns policy will be processed within 15 business days following receipt and verification of the returned product. The refund will be made using the same payment method used in the original purchase. Digital services are non-refundable once their provision has begun, unless CCM is unable to meet the agreed service levels.
XVI. Prohibited Conduct
It is strictly prohibited for Users and Clients of the Flotal platform to:
- Access the platform through unauthorized means or attempt to compromise its security systems.
- Share or transfer access credentials to third parties not authorized by CCM.
- Use the platform for illegal, fraudulent activities or activities contrary to morality and good customs.
- Reproduce, copy, distribute or commercialize any element of the platform without express authorization from CCM.
- Introduce viruses, malware or any malicious code that could damage the platform or its systems.
- Reverse engineer, decompile or disassemble the Flotal platform software.
- Collect data from other users or companies registered on the platform without their consent.
- Interfere with the normal operation of the platform or intentionally overload its servers.
- Impersonate CCM, its employees or other users of the platform.
- Publish or transmit defamatory, obscene content or content that violates third-party rights through the platform.
- Use fleet data from other Clients that may be accessed due to system error.
- Circumvent or disable any security measure or access control of the platform.
Violation of these prohibitions may result in immediate account suspension or cancellation, without prejudice to legal actions CCM may take to recover damages caused.
This list is illustrative but not exhaustive. CCM reserves the right to determine what conduct constitutes unacceptable use of the platform.
XVII. Intellectual Property
All intellectual property rights in the Flotal platform, including but not limited to: source code, design, logos, trademarks, algorithms, database, documentation and content, are the exclusive property of CCM or its licensors.
Use of the Flotal platform does not grant the User or Client any intellectual property rights over the platform or its components. It is prohibited to:
Any unauthorized use of CCM intellectual property may give rise to civil and criminal proceedings under the Federal Copyright Law and Industrial Property Law in force in Mexico.
- Reproduce, modify or create derivative works from any element of the platform.
- Use CCM trademarks, logos or trade name without express written authorization.
- Remove or alter any copyright or intellectual property notices on the platform.
- Register domains, trademarks or trade names similar to those of CCM or Flotal.
- Commercialize or sublicense access to the Flotal platform to third parties.
Fleet data generated by the Client through the platform is their property and CCM processes it solely for the provision of contracted services.
XVIII. Platform Use License
CCM grants the Client a limited, non-exclusive, non-transferable and revocable use license to access and use the Flotal platform during the term of the service contract, exclusively for the purposes described in said contract.
This license is conditioned on compliance with these Terms and Conditions and the service contract. CCM may revoke it at any time due to Client or User non-compliance.
- Sublicense or transfer platform access to unauthorized third parties.
- Use the platform outside Mexican territory without express authorization from CCM.
- Integrate the platform with third-party systems without prior technical approval from CCM.
- Access data from other companies or fleets registered on the platform.
The license does not include the right to:
XIX. Violation of Third-Party Rights
The Client and User undertake not to use the Flotal platform to:
- Infringe third-party intellectual property rights.
- Engage in activities constituting unfair competition.
- Publish confidential third-party information without authorization.
- Harass, threaten or defame natural or legal persons.
- Violate any applicable legal provision regarding personal data protection.
XX. Changes and Modifications to the Terms
CCM reserves the right to modify these Terms and Conditions at any time. Modifications will be communicated via notification on the platform and/or by email with at least 15 days' notice before taking effect. Continued use of the platform after such notification will constitute acceptance of the new terms.
XXI. User Liability
The User is solely responsible for the accuracy and truthfulness of the information provided on the platform, as well as the use made of reports, alerts and data generated by Flotal.
Operational decisions made based on platform information are the exclusive responsibility of the Client and User. CCM provides the platform as a management support tool but does not guarantee the complete absence of errors in the data.
The User will be liable to CCM and third parties for damages caused by improper or illegal use of the Flotal platform.
XXII. CCM Liability
CCM undertakes to provide services with due diligence and to keep the Flotal platform operational in accordance with the service levels agreed in the contract.
CCM will not be liable for indirect, incidental, special or consequential damages arising from use or inability to use the platform, including but not limited to data loss, loss of profits or reputational damage.
CCM's total liability to the Client for any cause shall not exceed the amount paid by the Client in the 3 months prior to the event giving rise to the claim.
CCM does not guarantee uninterrupted platform availability, although it undertakes to make its best efforts to minimize any service interruption and to provide advance notice of scheduled maintenance.
CCM will not be responsible for the malfunction of third-party devices (sensors, GPS, communication equipment) that are not of its manufacture, provided the problem is attributable to such devices.
XXIII. Denial and Suspension of Access
CCM reserves the right to suspend or cancel User or Client access to the Flotal platform at any time, with or without cause, including (but not limited to) violation of these Terms and Conditions, non-payment, fraudulent use or activities that may compromise platform security or other users' security. In case of suspension due to a cause attributable to the Client, there will be no right to a refund of payments made.
XXIV. Advertising and Communications
By registering on the Flotal platform, the User agrees to receive communications related to contracted services (system notifications, invoices, technical support). These communications are essential for service provision and cannot be deactivated.
Commercial communications (newsletters, promotions, news) are optional and the User may unsubscribe at any time through the cancellation link included in each email or by contacting contacto@flotal.com.mx.
XXV. Hyperlinks to Third-Party Sites
The Flotal platform may contain links to third-party websites. CCM does not control and is not responsible for:
- Content published on third-party websites linked from Flotal.
- Privacy practices or usage policies of third-party sites.
- The availability or operation of external sites.
- Any damage or loss resulting from accessing third-party sites.
- Products or services offered on linked third-party sites.
- Transactions made on linked third-party sites.
We recommend reviewing the terms and privacy policies of any third-party site accessed through links on our platform.
XXVI. Use of Cookies
The Flotal platform uses cookies and similar technologies to improve the user experience, authenticate sessions, analyze traffic and personalize content. Essential cookies are necessary for platform operation and are always active.
Analytical and preference cookies require your consent. You can manage your preferences through the cookie banner on our site. See our Privacy Notice for more information on cookie usage.
By accepting the use of cookies, you allow CCM to continuously improve the services offered on the platform. You may withdraw your consent at any time by modifying your browser settings or through your account privacy panel.
XXVII. Personal Data Protection
The processing of personal data collected through the Flotal platform is governed by the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.
CCM implements technical, administrative and physical security measures to protect your personal data against unauthorized access, loss or alteration. For more information on the processing of your data, please consult our Comprehensive Privacy Notice available at flotal.com.mx/aviso-de-privacidad.
You may exercise your ARCO rights (Access, Rectification, Cancellation and Opposition) by sending a request to privacidad@flotal.com.mx.
XXVIII. Applicable Law and Jurisdiction
These Terms and Conditions are governed by the laws of the United Mexican States. For the interpretation and enforcement of these terms, the parties expressly submit to the jurisdiction of the competent courts of Tuxtla Gutiérrez, Chiapas, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.
In the event of a dispute arising from these Terms and Conditions, the parties will endeavor to resolve the conflict amicably within 30 calendar days. If no agreement is reached, the matter will be submitted to the courts indicated in the preceding paragraph.
