Terms and Conditions of Use of the Digital Platform

To browse the website under the www.flotal.com.mx domain, you are not required to enter your personal data, as you will remain anonymous during your visit. Only when you register as a User will your personal data be incorporated into our database and used solely to provide our services. If you have given your express consent, and until you revoke it, your data may also be used to send you commercial information that may be of interest to you, such as promotions, coupons, and news (please review our PRIVACY NOTICE).

Remember that to use our tire administration and control software for your ground vehicle fleet via the website under the www.flotal.com.mx domain and our application called FLOTAL, you must open an account. To open an account, you must register your personal data and choose a password for access. This will allow you to have full control over your trucks, including their location, performance, maintenance, and tire control for your fleet.

We appreciate your interest in using our services or purchasing our products, but please note certain limitations on who may use or purchase them.

You may not use our services and/or purchase our products:

• If you do not have the legal capacity to contract or enter into a binding agreement with FLOTAL.
• If you are 17 years old or younger; you must refrain from creating an account, uploading content, or sharing personal information with us.
• If you have been previously prohibited from using our services.
• If you are the legal representative of a legal entity, you must have full capacity to bind and legally obligate that entity.

CENTRO CAMIONERO MONTAJES collects the personal data necessary to properly provide the services requested by its Clients and Users. Therefore, the User will provide identifying, location, geolocation, contact, and/or any other type of personal data at the time of enrolling and using the digital platform www.flotal.com.mx and our application called FLOTAL.

These collected personal data will be used to manage the administration, performance, maintenance, and control of the tires in your ground vehicle fleet, as well as to gather key information about those vehicles.

• Ensure that their Users register with accurate and truthful information through the digital platform www.flotal.com.mx and our mobile application called FLOTAL.
• Accept the Terms and Conditions and the other privacy policies and conditions stipulated through the digital platform www.flotal.com.mx and our FLOTAL app.
• Accept the service and/or product conditions included in the Service Agreement and the Software License Agreement.
• Pay in full for the contracted services and products.

• Register with accurate, truthful, and up-to-date information, including company data, department, fleet, vehicle catalog, tire catalog, fleet technicians, tire pressure sensors, and other catalogs and modules enabled for full control of your fleet.
• Accept the Terms and Conditions and the other privacy policies and conditions stipulated through the digital platform www.flotal.com.mx and our FLOTAL app.
• Accept the service conditions through the digital platform www.flotal.com.mx and our FLOTAL app.

The services offered by CENTRO CAMIONERO MONTAJES primarily consist of granting its clients the use and operation of digital infrastructure (digital platform and mobile applications) that enables their Users to optimize the administration, performance, maintenance, and control of the clients’ ground vehicle fleets’ tires, as well as collect key information about those vehicles and their components.

In turn, the products offered by CENTRO CAMIONERO MONTAJES primarily consist of the sale and installation of tire pressure sensors.

Therefore, any User who accesses the digital platform www.flotal.com.mx and our FLOTAL app is subject to these Terms and Conditions, privacy policies, the Service Agreement, and the Software License Agreement.

Prices will correspond to the model of tire pressure sensor acquired by the Client and/or the services the Client requires for the administration, performance, maintenance, and control of the tires of the Client’s ground vehicle fleet. Accordingly, the price to be paid to CENTRO CAMIONERO MONTAJES will be the one previously accepted in the quotation and confirmed in the Service Agreement.

CENTRO CAMIONERO MONTAJES does not guarantee maintaining product and/or service prices once the term of the Service Agreement has expired, nor is it responsible for any changes thereto.

CENTRO CAMIONERO MONTAJES will not be responsible for failures occurring in the communications of banking entities, nor for damages caused to the Client by the actions or omissions of such entities, and will likewise not be responsible for any interruption in the Client’s connection.

Once CENTRO CAMIONERO MONTAJES verifies payment, it may proceed with acceptance and provision of the contracted services.

CENTRO CAMIONERO MONTAJES will deliver the model of tire pressure sensor you previously selected, in perfect condition, to the address you indicate on the purchase request, and where it can be received during business hours to ensure delivery.

Please make sure to provide correct and complete shipping details, and ensure that someone is present at the specified address to receive the shipment. If the product is returned due to an incorrect address or the recipient’s absence, we cannot cover additional shipping costs for the return to origin or for resending the product.

When you purchase tire pressure sensors, CENTRO CAMIONERO MONTAJES will proceed to prepare and dispatch the product within the next 48 business hours so it can be delivered by the courier within Mexico.

Delivery time depends on many factors, such as the date your payment is approved by your bank, the location where you request delivery, year-end or promotional seasons, among others. Please note that shipping cost may also vary depending on the size, weight, and destination.

CENTRO CAMIONERO MONTAJES does not exchange a tire pressure sensor you purchased if you decide you prefer a different model. For any information in this regard, please contact us via email at ventas_cecam@gpomontajes.com.

You must send us the complete product, in perfect condition, to the address indicated in the email, and you are responsible for paying the shipping costs.

CENTRO CAMIONERO MONTAJES accepts a return of the product you purchased if it is not to your liking (THIS HAS NEVER HAPPENED). To do so, you must send an email to ventas_cecam@gpomontajes.com within 30 calendar days following receipt of the tire pressure sensor model, attaching images of the product.

You must pay the shipping costs and send us the complete product in perfect condition. The RETURNS department will process the refund within the next 7 business days if it verifies that the product is in good condition.

Pursuant to Article 77 of the Federal Consumer Protection Law (Mexico), CENTRO CAMIONERO MONTAJES offers a 1-year warranty on certain models of tire pressure sensors, counted from the date of delivery, covering defects in quality, suitability, safety, operation, and proper condition.

CENTRO CAMIONERO MONTAJES undertakes to repair product defects free of charge, including freight and the supply of necessary replacement parts. If the product cannot be repaired, CENTRO CAMIONERO MONTAJES will send you a new one or refund the amount you paid for it.

If the defects recur, you may choose a new repair, a full or partial refund of the price you paid for the product, or a full or partial replacement of the product.

Once the product is returned, CENTRO CAMIONERO MONTAJES will issue a receipt and repair certificate stating the following:

• Description of the repair performed.
• Parts replaced or repaired.
• Date on which the user delivered the product.
• Date of return of the product.

In any case, CENTRO CAMIONERO MONTAJES is released from the obligations arising from the warranty when it is demonstrated that the defect in the product is due to:

• Force majeure or unforeseeable circumstances.
• Acts of a third party.
• Improper use of the product by the user.
• Failure by the user to follow the installation, use, or maintenance instructions indicated in the product manual and/or the warranty.

Notwithstanding the provisions in the WARRANTY section, CENTRO CAMIONERO MONTAJES does not issue refunds for any reason. For more information, please review the Service Agreement you previously signed with CENTRO CAMIONERO MONTAJES.

The following are prohibited under applicable law and by CENTRO CAMIONERO MONTAJES:

• Entering false personal data.
• Manipulating prices.
• Introducing devices—such as viruses—that interfere with activities or affect the website under the www.flotal.com.mx domain.
• Sending emails or messages that contain or transmit any type of virus intended to disrupt the normal operation of the website under the www.flotal.com.mx domain.
• Any act that causes damage or harm to the operation of the website under the www.flotal.com.mx domain.
• Any act or event contrary to Mexican law.
• Any act that misleads consumers through advertising or any other means.
• Any act that interferes with the security of the website under the www.flotal.com.mx domain, such as transmitting or distributing any notices or messages containing viruses.
• Any act that infringes intellectual property rights over registered trademarks, trade or industrial secrets, or copyrights.
• Copying, reproducing, or exploiting FLOTAL’s reputation or rating in any context.
• Any act or product that induces deception or a false appearance.
• Any act that reverse-engineers FLOTAL.

In accordance with the foregoing prohibitions, any Client or User who engages in any of the prohibited acts will be investigated by CENTRO CAMIONERO MONTAJES, and may be sanctioned with termination of the contracted service or the commercial relationship.

Note: The above list is illustrative, not exhaustive. CENTRO CAMIONERO MONTAJES may deem any other harmful behavior by Users to be prohibited, including conduct identified in current Mexican laws and their possible amendments.

CENTRO CAMIONERO MONTAJES is protected by national and international regulations. Accordingly, it does not grant you any ownership rights, interests, or title over its assets, nor over content belonging to other persons who use the services, trademarks, logos, copyrights, patents, industrial designs, or other features of FLOTAL.

The Client and User may use FLOTAL only if authorized in writing through the Software License Agreement. Do not remove, hide, or alter legal notices displayed on our websites www.flotal.com.mx and/or mobile applications, or in their content.

Accordingly, you must refrain at all times from:

• Using FLOTAL for purposes contrary to law, morality, generally accepted good customs, or public order.
• Reproducing, copying, distributing, or making FLOTAL available to the public.
• Removing, circumventing, or tampering with any texts, legends, or messages intended to protect intellectual property rights over the contents, as well as any technical protection measures that FLOTAL may contain.
• Distorting, mutilating, or modifying FLOTAL in any way.
• Misusing contents and, in particular, any type of information obtained through FLOTAL and the website under the www.flotal.com.mx domain.

Any unauthorized use of FLOTAL will entitle us to initiate the legal actions necessary to safeguard our rights.

CENTRO CAMIONERO MONTAJES grants the Client a limited, temporary, non-transferable, non-exclusive, and revocable license to use and operate FLOTAL, provided the Client complies with these Terms and Conditions, the privacy policies, the Service Agreement, and the Software License Agreement.

This license does not include:

• The resale or commercial use of FLOTAL or its content.
• The collection and use of listings of CENTRO CAMIONERO MONTAJES products, services, or prices.
• Any derivative use of FLOTAL or its content.
• Data mining, robots, or data gathering and extraction tools.

Any unauthorized use of FLOTAL will entitle us to initiate the legal actions necessary to safeguard our rights.

If any Client, User, or third party believes that any content that CENTRO CAMIONERO MONTAJES has uploaded to FLOTAL or to the website under the www.flotal.com.mx domain infringes their intellectual property rights, such Client, User, or third party must send an email to legal@flotal.com.mx containing the following:

• Personal details: Full name, physical address, telephone number, and email address of the claimant.
• Authentic signature or equivalent, along with the personal details of the holder of the allegedly infringed intellectual property rights and/or their legal representative.
• Precise and complete identification of the allegedly infringing content, as well as its location on FLOTAL or on the website under the www.flotal.com.mx domain.
• An explicit and clear statement that the use of the indicated content has been carried out without the consent of the holder of the allegedly infringed intellectual property rights.
• An explicit and clear statement, made under the claimant’s responsibility, that the information provided in the notice is accurate and that the use of the content would constitute an infringement of their intellectual property rights.

CENTRO CAMIONERO MONTAJES will review these terms from time to time, and we will always publish the most up-to-date version on FLOTAL or on the website under the www.flotal.com.mx domain. If a revision materially reduces your rights, we will notify you in a timely manner (for example, via a message to the email address linked to your account, on this page, among others). By continuing to use or access the services after the effective date of the revisions, you agree to be legally bound by the Terms and Conditions.

The User will be liable for any damages and losses that CENTRO CAMIONERO MONTAJES may suffer, directly or indirectly, as a result of non-compliance with these Terms and Conditions or with the law. The User acknowledges and agrees that access to and use of FLOTAL is carried out at their own account, risk, and responsibility.

The User will be responsible for taking appropriate measures and acting diligently when accessing FLOTAL. Part of such diligence involves having protection programs—antivirus, malware and spyware management, and similar tools. In addition, the User must keep backup copies of the programs and data on the device through which they access FLOTAL.

Based on the foregoing, the User is solely responsible for maintaining the confidentiality of their username and password, and undertakes with CENTRO CAMIONERO MONTAJES to immediately notify any unauthorized use of their account via the following email: soporte@flotal.com.mx.

CENTRO CAMIONERO MONTAJES, its employees, and associated third parties do not guarantee that the use of FLOTAL will be uninterrupted or error-free, nor do they guarantee the continuity, availability, or proper operation of FLOTAL. Accordingly, at any time and without prior notice, CENTRO CAMIONERO MONTAJES has the authority to block, interrupt, or restrict access to FLOTAL without incurring any liability (contractual or non-contractual).

CENTRO CAMIONERO MONTAJES does not control or guarantee that the content is free of errors, viruses, or other elements of a similar nature that may cause alterations to the user’s computer system (software and hardware) or to electronic documents and files stored therein.

Under no circumstances shall CENTRO CAMIONERO MONTAJES or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use FLOTAL, including damages resulting from reliance on information obtained on the digital platform or mobile applications that may cause errors, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any other type of malfunction—whether or not such issues result in financial loss.

In addition, CENTRO CAMIONERO MONTAJES does not guarantee the truthfulness, accuracy, completeness, or timeliness of the content, nor does it guarantee the lawfulness, reliability, usefulness, and/or fitness for a particular purpose of FLOTAL. Therefore, it shall not be liable for damages that the User may suffer due to the lack or absence of such characteristics.

By accessing FLOTAL, you expressly agree that its use is undertaken at your sole responsibility and risk.

CENTRO CAMIONERO MONTAJES reserves the right to deny or withdraw access to FLOTAL, at any time and without prior notice, to Users who breach these Terms and Conditions or any other applicable provision.

The organizations, products, and/or services that CENTRO CAMIONERO MONTAJES advertises on FLOTAL or on the website under the www.flotal.com.mx domain, as well as any links, are not affiliated with or related to us. We play no role in the production of those products and/or the provision of those services, and no warranty—express or implied—of their content or fitness for a particular purpose is made. Thus, for example, when the use of any product and/or service is suggested, it is solely your decision to use it, and therefore CENTRO CAMIONERO MONTAJES assumes no responsibility for any direct or indirect damages, actual or potential, past, present, or future, that may result from such use.

Accordingly, any transactions you carry out with third parties unrelated to CENTRO CAMIONERO MONTAJES arising from advertisements of products and/or services, as well as any visits you make to their websites through links, are undertaken solely at your own risk and do not in any way entail liability for CENTRO CAMIONERO MONTAJES.

Users and, in general, anyone who wishes to establish a hyperlink from their pages directing their browser to the website must comply with the following conditions:

• The hyperlink shall allow access only to the homepage of the website under the www.flotal.com.mx domain.
• No browser, frame, or border environment shall be created around the website’s pages.
• The inclusion of the hyperlink shall not have the purpose or effect of displaying the website’s pages within a site not controlled by CENTRO CAMIONERO MONTAJES.
• No false, inaccurate, or incorrect statements about the website shall be made. In particular, it shall not be stated or implied that CENTRO CAMIONERO MONTAJES has authorized the hyperlink or has supervised or assumed in any way the content or services offered or made available on the webpage containing the hyperlink.
• Except for the signs that form part of the hyperlink itself, the webpage on which the hyperlink is established shall not contain any trademarks, trade names, business signs, designations, logos, slogans, or other distinctive signs owned by or licensed to CENTRO CAMIONERO MONTAJES.

CENTRO CAMIONERO MONTAJES may use cookies for various purposes, such as: (i) facilitating the User’s use of FLOTAL; (ii) collecting statistical data; (iii) verifying information; (iv) protecting information.

Some cookies expire when you end your user session and sign out of FLOTAL. Others are stored on your computer’s hard drive. If you wish to block FLOTAL cookies, use your browser’s help button and follow the necessary instructions. However, CENTRO CAMIONERO MONTAJES informs you that if you disable cookies, it may become difficult—or even impossible—to use FLOTAL and its various functions optimally.

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties and its regulations, CENTRO CAMIONERO MONTAJES informs you that it is responsible for collecting your personal data, for the use given to such data, and for their protection, in order to prevent unauthorized processing as well as any alteration, destruction, or damage to your personal data.

Please note that the personal data you have provided as their holder will form part of our database and will be used in accordance with the primary and secondary purposes set out in the PRIVACY NOTICE.

Likewise, CENTRO CAMIONERO MONTAJES informs you that the rights available to data subjects are those set forth in the Federal Law on the Protection of Personal Data Held by Private Parties, Chapter III (Rights regarding personal data held by private parties, Articles 21 to 26) and Chapter IV (Exercise of the rights of Access, Rectification, Cancellation, and Opposition, Articles 27 to 34).

This agreement is governed by current Mexican laws. Accordingly, all visits and all contracts and transactions carried out on FLOTAL, as well as their legal effects, shall be governed by these rules and subject to the applicable legislation in Mexico.

Any dispute arising from the use of FLOTAL and/or from these Terms and Conditions of Use shall be submitted to the jurisdiction of the competent courts of Tuxtla Gutiérrez, Chiapas, Mexico.
